NJ Supreme Court & Appellate Division Opinions 12-22-14

The New Jersey Supreme Court and Appellate Division have released multiple opinions this morning. Pay attention to the Supreme Court's opinion if you are a family law attorney. In New Jersey Division of Child Protection and Permanency v. Y.N., the Supreme Court held:

Absent exceptional circumstances, a finding of abuse or neglect cannot be sustained based solely on a newborn’s enduring methadone withdrawal following a mother’s timely participation in a bona fide treatment program prescribed by a licensed healthcare professional to whom she has made full disclosure.

The Appellate Division released two published opinions this morning:

1. D.A. VS. R.C. In a case involving a 'parenting time schedule', the Court reversed Chancery Division, Family Part and sent the case back for mediation to resolve issues regarding parenting time and custody. A copy of the opinion is available here:
