NJ Supreme Court & Appellate Division Opinions 12-23-14
The New Jersey Supreme Court and Appellate Division released the following opinions this morning. In Tomikia Davis v. Abbas Husain, the Supreme Court held:
Post-verdict discussions between the court and discharged jurors are prohibited unless those discussions are part of a hearing ordered on good cause shown pursuant to Rule 1:16-1.

The Appellate Division released one published opinion this morning:
1. NEW JERSEY DIVISION OF CHILD PROTECTION AND PERMANENCY VS. R.W. IN THE MATTER OF M.W. AND Z.W. The Appellate Division reversed a Family Part order entered in a Title Nine proceeding finding that she abused and neglected her infant. The Court concluded that defendant's use of marijuana on one occasion, while accompanied byher child, did not establish that she placed the child in imminent danger or at substantial risk of harm.
