NJ Appellate Division Opinions for 1-2-15
In the very first published opinions of 2015, the NJ Appellate Division released the following decisions:
1. NEW JERSEY DEPARTMENT OF ENVIRONMENTAL PROTECTION VS. ALLOWAY TOWNSHIP AND COUNTY OF SALEM AND WILLIAM R. COBB (L-95-08, SALEM COUNTY AND STATEWIDE)
Decision involving the maintenance and control of a dam. Opinion available here:
2. ROBIN B. WOJTKOWIAK VS. NEW JERSEY MOTOR VEHICLE COMMISSION AND NEW JERSEY DIVISION ON CIVIL RIGHTS (NEW JERSEY DIVISION ON CIVIL RIGHTS)
The central issue on appeal is whether the New Jersey Motor Vehicle Commission (MVC) discriminated against her by requiring her to appear at the nearest MVC location to be photographed for her driver's license. We hold that where the extent of a LAD claimant's disability is relevant to the reasonableness of the accommodations offered or demanded, the claimant must establish it by expert medical evidence. Because the extent of complainant's disability is not readily apparent from her medical evidence, the Court affirmed the decision. Opinion available here:
The Court also released the following unpublished opinions, copies are available here:
